Terms of Sale
These terms apply when you buy a custom trivia game from Toast & Trivia, through our Etsy shop, our Gumroad store, or by invoice. Toast & Trivia is operated by Canal Ventures LLC, a New Jersey limited liability company ("we," "us"). Email: hello@toastandtrivia.com.
If you order on Etsy or Gumroad, that platform's own policies also apply to your purchase and payment, alongside these terms.
1. What you're buying
Each game is made to order from the answers you give us in our order form. Delivery times (for example, "within 12 hours") are measured from when you submit your completed order form, not from the time of purchase. During busy holiday periods we may post order cutoffs on our listings and site.
2. Your photos, stories and other content
1. You keep ownership.
You own (or have permission to use) the photos, names, stories, quotes, logos and other material you send us ("Your Content"). We don't claim ownership of it.
2. What you promise us.
By sending Your Content, you confirm that: (a) you took the photos yourself or have the right to share them for this purpose; (b) the people shown or named, or a parent or guardian for anyone under 18, would be comfortable having them shown or read at your event; (c) Your Content doesn't include anyone's private information they haven't agreed to share (home addresses, phone numbers, financial, medical or health details); and (d) Your Content isn't unlawful, defamatory, hateful or sexually explicit, and doesn't infringe anyone's copyright, trademark, privacy or publicity rights.
3. Permission you give us.
You give us a limited, non-exclusive, royalty-free permission to copy, edit, crop, resize, arrange and display Your Content only to create, deliver, revise and support your order. That includes processing it with the software and service providers we use to make your game or design, which may include AI-assisted writing and design tools. We will not use Your Content in our advertising, samples, social media or portfolio, or share it with anyone else for their own use, unless you give us separate written permission (for example, a box you tick or an email saying yes). You can withdraw that permission at any time for future use.
4. Our right to decline.
We may decline, remove or ask you to replace any content we believe breaks these promises or isn't suitable to show at a party or service. If we can't complete your order without it, we'll offer a refund under our Refund Policy.
5. If someone objects.
If a claim is made against us because Your Content broke the promises in section 2, you agree to cooperate with us and to be responsible for the reasonable costs (including reasonable attorneys' fees) that result, to the extent caused by Your Content. This doesn't apply to anything caused by our own changes, mistakes, or misuse of Your Content.
6. Deletion.
We delete Your Content from our working files and backups within 30 days after delivery, and from our form and email providers within 60 days. Email hello@toastandtrivia.com to request deletion sooner. We keep only basic order records needed for tax and accounting, and they contain no photos or stories.
7. The finished product.
When your order is paid, you may use, copy, print and share the finished files for your personal (non-commercial) event as often as you like. We keep the rights in our templates, layouts, question formats and designs and may reuse them, never with Your Content, for other customers.
3. Refund Policy
Because every game is custom-made from your answers, here's how refunds work:
- Haven't submitted the order form yet? Full refund, no questions asked, within 14 days of purchase.
- Submitted the form but we haven't delivered yet? Full refund.
- Game delivered? We'll revise it within your tier's included revision rounds. If, after those revisions, the game still doesn't match your form, or we miss our delivery time by more than 2 hours and you no longer need it, you'll get a full refund.
- Errors on our end (wrong names, typos, facts that don't match your form) are always fixed free.
Refunds go back to your original payment method through Etsy or Gumroad. To request a refund or a fix, reply to your delivery email or contact hello@toastandtrivia.com.
4. AI disclosure
We write your questions and design your slides with the help of AI tools, using only the answers you give us. Every game is checked against your order form for accuracy and tone before delivery. Replies to order emails may be written by our automated assistant.
5. Partner (affiliate) program summary
Planners, DJs, venues and creators can join the Toast & Trivia Partner Program. In short:
- Commission: partners earn 20% of the Net Sale on each Qualified Order. "Net Sale" means what the customer actually paid for the game, after discounts and refunds, excluding sales tax, shipping and tips.
- Tracking: an order qualifies only if it's bought through the partner's Gumroad affiliate link within 30 days of the click, or the partner's promo code is actually applied at Etsy checkout. Etsy doesn't combine promo codes with shop-wide sales, so during our sales an Etsy code can't be applied. We can't credit orders we can't track.
- Payment and taxes: payments come from Canal Ventures LLC's business account. Partners provide an IRS Form W-9 before their first direct payment, and we file Form 1099-NEC when the IRS threshold is reached.
- Disclosure is required: partners must clearly say they earn a commission every time they recommend us, in the same place as the recommendation and before any link or code, for example "I earn a commission if you buy through my link." "#affiliate," "#partner," a tag, or a bio-only note is not enough.
- Honest claims only, no spam, no coupon-site posting, no bidding on our name in paid search, and no fake or incentivized reviews.

6. Responsibility and law
To the fullest extent New Jersey law allows, our liability for any order is limited to the amount you paid for it. This does not limit liability for our gross negligence or willful misconduct, or any right you have that cannot be waived under New Jersey law.
New Jersey law governs these terms. If any part of these terms is unenforceable, the rest stays in effect. We may update these terms; the effective date above shows when they last changed, and the terms in effect when you ordered apply to your order.
